1. INTRODUCTION AND ACCEPTANCE OF AGREEMENT

  • Thank you for choosing Travel Frame. We take all efforts to make sure that you have a delightful holiday experience. To avoid any misunderstanding, we request you to read, understand and abide by the below ‘Terms and Conditions’ along with Privacy Policy before you book any tour or holiday or any service or make any transaction with Travel Frame. Once you book any tour or service with Travel Frame, it is understood that you are giving your unqualified consent to accept and abide by the ‘Terms and Conditions’. In case you disagree with any part of these ‘Terms and Conditions’, kindly do not proceed with the booking.
  • ‘Terms and Conditions’ extend to all group tours, customized holidays, corporate tours, any other services, and products for Domestic, International, or Inbound organised by ‘Travel Frame’.
  • Travel Frame has the final authority on the interpretation of these ‘Terms and Conditions’.
  • Travel Frame reserves the right to amend, vary, add, amplify, or waive any stipulation, representation, term, or condition mentioned in the ‘Terms and Conditions’.
  • Under any unprecedented force majeure situation or any changes in Government policy, Travel Frame reserves the right to supersede any part of these ‘Terms and Conditions’ with an alternate and valid enforceable provision.
  • Each of these ‘Terms and Conditions’ shall be severable and if any provision thereof is declared invalid, illegal, or unenforceable, then remaining provisions nevertheless shall have full force & effect.
  • These ‘Terms and Conditions’, together with the other booking related terms/ communication sent periodically, represent the entire agreement between Travel Frame and you.
  • There is no agreement between the Company and you until the company has received the initial registration amount/deposit.

2. DESCRIPTION

  • These ‘Terms and Conditions’ be called, ‘Travel Frame Terms and Conditions’.
  • These ‘Terms and Conditions’ may also be referred as ‘Rules and Regulations’.
  • Travel Frame will be hereinafter referred as ‘Travel Frame’, ‘the Company’, ‘the organization’, ‘we’, ‘us’ or ‘our’ and its guest will be hereinafter referred as ‘Guest/s’, ‘them’, ‘they’, their, ‘You’, ‘Your’, ‘tourist/s’, ‘traveller/s’, ‘client/s’, ‘customer/s’, ‘pax’, or ‘passengers’.
  • The website of Travel Frame is collectively referred to as ‘Website’.

3. DEFINITIONS

  • ‘Travel Frame’ works under the brand name ‘Travel Frame’, therefore, both these names will be considered one and the same and used synonymously therein.
  • ‘Website’ means www.travelframe.net and ‘Web page’ means a page on the Website www.travelframe.net.
  • ‘Brochure’ means a document with tour information in the form of printed brochure, E-brochure, Eitinerary, leaflet, booklet, travel planner, Tour Price list, Tour Information Email etc.
  • ‘Tour’ means any Domestic/ International/ Inbound Tour organized by Travel Frame.
  • ‘Group Tour’ means number of guests booked on any scheduled tour comprising minimum 20 guests for Indian tour and 30 guests for international tour.
  • ‘Corporate Tour’ means a special tour designed for corporates, industries, institutions, independent organisations, ad-hoc groups, or individuals to facilitate their meetings, incentives, conferences, exhibitions, seminars, team building and other events. This segment is also known as MICE i.e. Meeting. Incentive. Conference. Exhibition.
  • ‘Customized Holiday’ means a tailor-made holiday designed as per the requirements of an individual guest. This segment is also known as FIT.
  • ‘Inbound’ or ‘India Inbound’ means tours, packages or any service provided to foreign nationals or non-resident Indians to explore the states of India and the Indian Subcontinent.
  • ‘Speciality Tour’ means a group tour designed to meet special interest of travellers which include but not limited to Honeymoon Special, Women’s Special, Seniors’ Special, Singles’ Special, Short Trips, Cost Saver, Festival Tours, Adventure Tours, Trekking Tours etc.
  • ‘Sales Partner’ means Travel Frame’s authorized travel agent who possess the requisite licenses, permissions, expertise, and infrastructure to sell the tour/s organised by Travel Frame to all the prospective guests. These include sales channels such as PSPs i.e., Preferred Sales Partners; KSPs – Key Sales Partners, OSP – Overseas Sales Partners and franchisees.
  • ‘Travel Advisor’ means Travel Frame’s authorized sales person who assists and guides guests on booking their Travel Frame tour/service.
  • ‘Guest/s’ means all the tourists, travellers, vacationers, sightseers, visitors, backpackers, customers, clients who have registered their names or enquired about tour/ package or booked the tour by making part or full payment for any scheduled tour, customized package or any other travel related service provided by Travel Frame.
  • ‘Gender’ – The masculine gender shall also include feminine gender and vice versa, the singular shall include plural and vice versa and shall include grammatical variations if any.
  • ‘Tour price’ means the price mentioned in the Tour Package on the website/SMS/email/ WhatsApp/brochure / E-brochure/ leaflet/ advertisements on print, electronic and social media etc. which is to be paid by guests for booking the tour. Taxes, surcharges, if any, are payable over and above the Tour Price.
  • ‘Child’ means a guest who falls below the age of 11 years.
  • ‘Infant’ means a guest who falls below the age of 2 years.
  • ‘Extra bed’ or mattress means an additional roll-on mattress on floor in twin/ double bed room.
  • ‘Surcharge’ means an additional fee/ charge/ tax over and above the initially quoted tour price which is due to peak season/ special event, charged by the associates/ suppliers/ contractors/ tourism or government authorities.
  • ‘Peak Season’ and ‘Super Peak Season’ are the seasons of the year where the demand surpasses the supply which results in overall cost increase. This includes but is not limited to Summer Vacation, Diwali Vacation, Christmas Vacation, New Year Holidays, any Country Specific Vacation/ Festival or National/International Events etc.
  • ‘First Day/ Last Day/ Day’ of the tour shall start at any time (i.e., in the morning / afternoon / evening /night/ midnight) at the first destination depending on the arrival of the respective flight/ train/ cruise or any other mode of transport and the same shall be in case of the last day of the tour. In other words, a ‘Day’ of the tour shall mean a part of the day or 24 hours or its part thereof.
  • ‘Meal Service’ on tour comprise of pre-set breakfast (B)/ lunch(L)/ dinner(D) and/or any other snack and mineral water bottle as mentioned in the itinerary.
  • ‘Jain Meal’ on tour means food without onion & garlic served at Lunch and Dinner as per the tour itinerary, not necessarily before sunset. It may be a buffet service or a table service.
  • ‘VISA’ means ‘Visitor’s International Stay Admission’ is a conditional authorization granted by the immigration authorities of a territory to foreigners allowing them to enter, remain within, or to leave that territory for a specified period. This is in the form of a paper authorisation or a stamp/sticker endorsed on the applicant’s passport. Travel Frame is a facilitator and does not have any role in the granting / rejecting of the Visa.
  • ‘Force Majeure’ means an event or circumstance not within the control, directly or indirectly, of Travel Frame in its ability to perform its obligations/ responsibilities regarding the tour, including:
    a.) war, hostile invasion, act of foreign enemies;
    b.) rebellion, revolution, terrorism, insurrection, or civil war;
    c.) political unrest, government orders, riots, commotion, disorder, curfews, strikes, lockouts etc.;
    d.) any act or omission of any government instrumentality;
    e.) a change in legal requirements;
    f.) infectious diseases, epidemic, pandemic;
    g.) explosion, fire, flood, drought, tsunami, earthquake, volcanic eruption, hurricane, tempest,typhoon, cyclone, snowstorm, thunderstorm, landslides and other exceptional natural calamities and acts of God;
    h.) ionizing radiation or contamination by radioactivity from any nuclear fuel/ waste or radioactive toxic explosive of any nuclear assembly.
  • ‘Cancellation Policy’ means a policy laid down in Travel Frame’s ‘Terms and Conditions’ wherein applicable cancellation charges are specified which are to be borne by the guests on cancellation of their tour.
  • ‘Cancellation Charge’ means a charge borne by the guest upon cancelling their tour for any reason whatsoever.
  • ‘Refund’ means repayment of the sum of money to the guest paid by him/her at the time of booking the tour after deducting the applicable cancellation charge.
  • ‘Operational Expense’ means expenses that Travel Frame must incur through its normal course of business to conduct its tours and business operations.
  • ‘Jurisdiction’ means the geographical area over which a court or government body has the power and right to exercise authority. For any legal matter involving the company, parties hereto agree to confer exclusive jurisdiction to Haryana Courts / Forums.

4. BOOKINGS

Booking of Tour, Customized Holiday, Corporate Tour, Inbound and any independent service through Sales Channels or Online through website/ mobile app:

a.) Any guest who enquires about or purchases any product offered by Travel Frame through its website, branch office / sales office or through call agrees to enter a contract with Travel Frame. A contract is said to have been executed by both the parties i.e., Travel Frame and the guest. Once a contract is executed, both the parties are bound by the ‘Terms and Conditions’ mentioned on Travel Frame’s website/ travel planner/ brochure/ booking form.
b.) When a guest books the product/ service offered by Travel Frame, provides his/her information and consent for initiating the booking and thereafter makes the payment of registration amount, indicates that the guest is interested in the tour and has read, understood, and accepted all the ‘Terms and Conditions’ mentioned on Travel Frame website/ travel planner/ brochure / booking form.
c.) In case, the booking formalities are processed by the guest on behalf of his/her family, s/he is deemed to have been authorized to do so by his family members after reading, understanding, and accepting all the Travel Frame ‘Terms and Conditions’ mentioned on the website/ travel planner/ brochure / booking form.
d.) A guest must be eighteen (18) years or above to make a booking with Travel Frame.
e.) A guest must ensure that all the information provided by him/her while filling the booking form is accurate, as booking is processed based on this information. In case of any incorrect information, the loss or cost incurred for amendment will be borne by the guest.
f.) Travel Frame reserves the right to accept or to decline any booking of any person/s or cancel the booking without assigning any reason.

Corporate Tour Booking: In case of Corporate Tour, along with these ‘Terms and Conditions’, terms of ‘Service Contact’ signed with corporate/ industry/ institution/ independent organization/ ad-hoc group etc. shall also apply. ‘Service Contract’ is generally signed by the authorized personnel of corporate/ industry/ institution/ independent organization/ ad-hoc group etc. and the terms are applicable to each member of the tour.

Communication with the Guest: Any communication by Travel Frame will be made through e-mail, WhatsApp, SMS, telecall etc. on the registered legitimate contact details provided on the booking form by the guests and shall be deemed to have been communicated to and received by the guest. Guest’s must ensure that number is valid and messages are checked periodically. Travel Frame is not a mobile network operator and does not guarantee the delivery of SMS-text messages/ WhatsApp messages/ email.

Physical and Mental Fitness: When the guest books the tour or when someone else books the tour for him/ her, then it implies that the guest is physically and mentally fit to travel to that destination. It is very important for the guest to take care of his/ her health throughout the tour and carry the required medication if any with doctor’s prescription. Travel Frame reserves the right to decline the booking or discontinue the guest from the tour if guest is found unfit to travel or his medical condition is causing inconvenience to fellow travelers. Any expenses due to health issues arising on tour shall be entirely borne by the guest and we shall not be held responsible in any manner whatsoever.

Mandatory Health Requirement: Guests must abide by the mandatory requirements for travel to the destination, such as Vaccination, RT-PCR tests, RAT, web check-in, self-declaration, e-pass formalities, health checks on arrival/ on tour etc. as per the state or country. These requirements or regulations are subject to change periodically. Any cost incurred for such requirements should be borne by the guests. It will be the sole responsibility of the guest to carry the certificate or test report with them and present it whenever asked for by the officials. Any State or Country or service provider such as Airline, Cruise Company, Railway may decline the entry to a guest/s on medical grounds in such situation the consequences including all kinds of expenses will be borne by the guest.

Travel During Pregnancy: Travel Frame does not recommend travel during pregnancy. The Company does not provide any specialized facilities and/or treatments required for childbirth, prenatal, or early infant care on tour. Guest should consider the risks of traveling where necessary medical care for pregnancy may not be available and may not be reachable in a timely manner to address potential medical complications, problems, and emergencies that can occur during pregnancy.

5. TOUR PRICE, TOUR REGISTRATION, PAYMENT

  • To book any tour/ package/ service, guest must make the payment to Travel Frame by Cheque, Demand Draft, NEFT, RTGS, IMPS, Payment app/ wallets like BHIM, PhonePe, Gpay, PayTM or any UPI ID. All payments should be in the name of ‘Travel Frame’ only. We support ‘Go Digital’ movement of India and request our guests to make digital payments. Cash payment in INR will be accepted as per the Government of India guidelines along with PAN. Kindly note, outstation cheque is not accepted.
  • In case of payments made using Credit Card, Debit Card and Online Transfer, convenience charges shall be levied and will be paid extra by the guest.
  • The tour price printed / advertised / quoted to the guests is dynamic. The price may change at the time confirmation of booking subject to the available rates.
  • It is a clear agreement between either parties that the prices quoted in the proposal/ brochure/ website have been calculated based upon the prevailing airline/ hotel/ transport tariffs and applicable taxes thereon. The Company reserves the right to alter or amend the price published on the website/brochure/ proposal in case of increase in taxes, fuel charge, YQ/YR taxes, visa fee, unprecedented foreign exchange fluctuation etc., which will have to be borne by the guest and to be paid before the departure.
  • Tour price does not include government taxes and are to be paid extra. As per government’s current regulations, GST (Goods and Services Tax) is applicable on every tour/package and guests will have to pay the same over and above the tour price. In addition to this, effective from 1st October 2020, government has levied TCS (Tax Collected at Source) on international/overseas travel packages. The TCS rate is either 5% or 10% depending of certain requirements. Those guests who have submitted PAN copy, Aadhaar copy and have filed their Income Tax Returns (ITR) for previous two assessment years need to pay 5% TCS. Those guests who do not possess PAN and Aadhaar or have not filed their Income Tax Returns (ITR) for previous two assessment years, will have to pay 10% TCS. The TCS collected can be claimed while filing annual income tax returns. The TCS amount will reflect in the Form 26AS of the guest in whose name invoice is raised (i.e., Lead Guest whose name is mentioned on invoice), irrespective of the person who has made the payment for the tour/package. Hence while booking guests must ensure that the lead guest is selected properly in order to claim the benefit at later stage. Once the TCS amount is collected from the guest, it cannot be refunded by Travel Frame, as it is paid to government and reflects against the Form 26AS of the guest. The TCS is not applicable in case of corporates, who possess TAN (Tax deduction & collection account number) and claims TDS while making their tour/package payment.
  • If the guest has booked the tour online, the guest needs to reconfirm and authenticate the information provided at the time of online booking. Company reserves the right, to cancel the booking and forfeit the amount paid in case of any misleading information provided by the guest.
  • The registration amount paid at the time of booking is non-refundable and interest free, subject to the Cancellation and Refund Policy. Registration amount differs from tour to tour. Payment of registration amount ensures only registration/ participation in the tour and does not entitle to the guest of any services like air tickets, visas, and hotel accommodation until full payment for the tour has been made by the guest and received by Travel Frame. As per payment guidelines stated, tour price must be paid in full, 30 days before the tour departure; in case if tour is booked within 30 days of the departure date, guests must make full payment of the tour price at the time of booking itself. For any reason if the registration amount is not paid in full at the time of booking, guest will ensure that the balance registration amount is paid within 6 days of booking; else booking stands cancelled.

  • Travel Frame reserves the right to cancel the booking, forfeit the amount paid as advance and impose cancellation charges in case of non-payment of full tour price 30 days prior to the tour departure date.
  • We reserve the right to cancel your booking without notice if the payment is not cleared by the timeline. Guest must make the payment in 3 instalments only. 1st instalment is registration amount, 2nd instalment is 50% of remaining package amount & 3rd instalment is remaining tour package amount.
  • In case the guest makes tour payment by cheque and the same is dishonoured, a charge of INR 500 will be levied by the Company and borne by the guests immediately.
  • The guest/ guests will not share his confidential information like credit/ debit card number, CVV, OTP, card expiry date, guest IDs, passwords etc. with any person including the employees, representatives, sales partners of Travel Frame. If such details are demanded by them then guest/ guests must not do any transaction and must immediately inform Travel Frame. Company shall not be liable for any loss that the guest incurs for sharing the aforesaid details.
  • All monies paid by the guest to Travel Frame will be the property of Travel Frame and payable to our Suppliers/ Contractors/ Associates for pre-blocking/ pre-booking and providing the services along with operational costs of the company. Guests agree and acknowledge that such monies will not be held by Travel Frame on behalf of the guest.

6. GENERAL INCLUSIONS IN GROUP TOUR (GIT)

  • Any group tour of Travel Frame generally includes –
    a.) Airfare (wherever applicable).
    b.) Accommodation.
    c.) Transport.
    d.) Meals as mentioned in the itinerary.
    e.) Sightseeing as mentioned in the itinerary.
    f.) Tour Guide services if applicable.
    g.) Visa Fees of Indian Nationals excluding ‘Gratis Visas’/ on arrival free visas/ free visa.
    h.) Driver and guide tip.
  • This list is illustrative and not a complete list and includes all the other inclusions as mentioned in the itinerary of the respective tour.

7. GENERAL EXCLUSIONS IN GROUP TOUR (GIT)

  • Gratis/ free of cost Visas which are not included in the tour price.
  • Expense of any personal nature such as porterage, laundry, telephone charges, shopping, beverages, additional mineral water, or food which is not a part of the pre-set menus.
  • Courier charge for any specific requirement.
  • Any transport charge (unless mentioned) to reach the reporting point of the tour and onwards from the dropping point of the respective tour.
  • Expense incurred in case of discontinuation of the tour for any reason.
  • Additional expense incurred for any unforeseen circumstance like scheduled flight cancellation, unscheduled accommodation or for any force majeure situation.
  • Any increase in government taxes, fuel surcharges, YQ taxes, airfare, airport development fee, transport charges, visa fees, sightseeing charges etc.
  • Additional charge for pre or post air ticket deviation from the scheduled tour programme w.r.t. date or sector.
  • Any excess luggage charge levied by the airline/ cruise/ rail/ transport company. This list is illustrative and not a complete list and includes all the other exclusions as mentioned on the website/ brochure/ itinerary of the respective tour.
  • Any upgradation charge towards first class, business class, premium economy, seat selection, separate vehicle, room category change etc. levied by the associates like airline/ cruise/ rail/ hotel/ transport company in not included in the tour price and guest will have to pay the same in addition to the tour price.

8. DOCUMENTATION

  • Documents Required for Booking a Tour:
    a.) A guest must have a valid photo ID Proof for booking a domestic tour and a valid passport for booking an international tour. As per the circular issued under RBI regulations, submission of PAN for domestic as well as international tours is mandatory. A guest must also submit all the documents as per the rules and guidelines issued by the respective visa consulate/embassy.
    b.) It shall be the sole responsibility of the guest to hold valid travel documents and statutory clearances such as passports, visas, confirmed air tickets, insurance, any medical or legal certificates etc. to travel on the tour.
    c.) If the guest does not possess the documents stated by the authorities or fail to submit within stipulated time, then the booking will be cancelled and cancellation charges will be applied.
  • Photo Identification: For domestic tours in India, all guests must carry the photo identification in the form of Aadhar card, election ID card, PAN card, driving license and school / college ID card for students as officials may ask for photo identification at airports, rail stations certain sightseeing places, safari parks, border area locations etc. and every guest must produce the same on demand.
  • Passport:
    a.) For travelling abroad, all guests including children and infants must be in possession of a machinereadable passport valid for minimum of 180 days from their tour return date, along with the applicable visas. Guest must check all the details of their passport for accuracy like name/ address/ validity/ expiry date/ blank pages for visas etc. Guests booking Europe tour should ensure that the passport validity is for a maximum of 10 years. Old passports with 20 years’ validity and handwritten passports are not
    accepted. Guest should ensure that the passports are well maintained, its pages are serially numbered and not damaged/ tampered/ scribbled/ stapled/ torn etc.
    b.) If any passport related issue leads to tour cancellation, then the guest is liable to pay applicable cancellation charges. For few tours, Travel Frame as a facilitator collects guest’s passport and submits to various private entities or consulates or embassy. Travel Frame does not hold responsibility and is not liable to pay compensation/ refund/ claim if the passport gets lost or damaged during this process as it does not have direct /indirect control on these authorities and their operations.
  • Visa (International Tours):
    a.) A visa is a mandatory authorization issued by the consulate that permits the guest/s to enter their country for a limited period of stay. Guest/s must ensure that they possess valid visas for joining the tour. Travel Frame is a visa facilitator, who assists guest/s for preparing visa documents, submitting them & collecting the passports from the consulate on their behalf wherever applicable. Few consulates send the passport directly to the guest’s residence.
    b.) During the visa process, the consulate may contact guest/s for more details or call for personal interview, irrespective of all relevant documents being submitted. Guests must ensure that correct address and contact details are filled on the visa application form. The decision to issue visa is at the sole discretion of the respective consulate and Travel Frame does not have any control on the decision of the consulate and cannot raise any objection to it either. Guest cannot take any legal action against Travel Frame on such rejection of visas.
    c.) Once the passport is received by the guest from the consulate, guest must verify the visa copy/ stamp for any error or discrepancy in the name, gender, passport number, type of entry, validity, date of entry/ exit, duration of stay (as per the tour itinerary) etc. Any discrepancy must be intimated immediately to Travel Frame’s Travel Advisor. We will try our level best to get it corrected from consulate, however the company cannot guarantee the in-time corrective action and will not be responsible for any consequences arising due to the same.
    d.) For Schengen visa of Europe tours, full payment of the tour price is to be made before processing the visa application. In case of part payment, sufficient bank balance equivalent to the total tour price must be maintained at least for six months by the guest/s in their bank account.
    e.) For certain countries, if the valid visa is on the old passport, then the guest has to carry both, the old as well as the new passport on tour. For certain countries guests are required to transfer the valid visa on the old passport to their new passport from respective consulate. Guests should get it transferred before the tour departure and bear the cost if any. Guests should keep themselves updated about the prevailing rules of the respective country/ consulate/ embassy.
    f.) If guests possess valid visa for the duration of the tour or wish to process the visa(s) on their own, then that should be brought to the notice of the Travel Frame Travel Advisor at the time of booking itself. In such case guests will be entitled to visa fee reduction.
    g.) It is the responsibility of the guest to submit all documents required for the application of the visa well in advance to Travel Frame. Guests must take a note that even if they have booked or submitted their visa documents sufficiently well in advance, few consulates have restrictions on how early a visa can be applied/ processed before the tour departure date. Due to the high demand at the consulates or embassies, visa processing time may be longer than expected. Sometimes even if we submit the
    documents well in advance, visas may get delayed and may not be received before the departure of the tour, in such case if guest cannot join the tour, then cancellation charges as per Cancellation Policy will apply.
    h.) Guests serving for the nation in high security institutions/ corporations or Defence/ Armed forces or Chemical/ Nuclear Industries, should book their tour early and apply for the visa well in advance as it is likely to take longer than usual visa processing time at the consulates. The requirement of their visa documents is somewhat different than a regular guest. Travel Frame as a facilitator, shall not be responsible for any consequences or not liable for any refund to the guest if their visa is delayed or not
    granted.
    i.) If guest has any dispute with the consulate/ embassy and decides to legally challenge the authority, Travel Frame will not be a party to it and will be unable to represent anything in that matter.
    j.) Any hike in visa fee/ VFS charge / service charge in between the tour launch and visa application date, must be borne by the guest.
    k.) Due to any reason whatsoever, sometimes we may need to apply for an additional visa other than the visa(s) which are already included in the tour price. In such case guests will have to bear the additional visa cost.
  • Travel Insurance:
    a.) It is advised that, all the guests travelling within India or overseas must possess Travel Insurance. This insurance has a limited cover which includes loss of baggage, flight delays/ cancellation, hospitalization, death, repatriation, evacuation etc. to a certain extent. Few adventure activities which are part of the tour itinerary may or may not be covered in the insurance policy.
    b.) Insurance copy is sent to the guests on their registered email ID before the tour departure and guests should verify all their personal details on the same and also be aware of the coverage under policy. It is mandatory for guests to carry their insurance copy on tour and present the same to the authorities when asked for.
    c.) In case of any incident leading to insurance claim, it is mandatory for the guest to intimate the Insurance Company and Travel Frame within 24 hours.
    d.) Overseas travel insurance policy is at the sole discretion of the respective insurance company. Travel Frame is just a facilitator who does not have any control over their operations or the claim process. Guests will have to directly communicate with the insurance company and provide necessary documents asked for the claim settlement. Any grant or rejection of the claim will be solely the decision of the insurance company and Travel Frame is not responsible for the same. Any dispute arising about adequacy of settlement amount or rejection of claim should be directly dealt with the Insurance Company by the guests.
  • Minors:
    a.) Child safety and protection is of utmost priority. To prevent abduction of children, almost all countries have laid down strict regulations which demand specific documents for visa application or whenever they travel. Children under 18 years of age must be accompanied by parent/s or an adult who shall be responsible for their welfare and supervision or should have a written consent letter from the parent/s to join the tour. It is the responsibility of the guest to take care of their accompanied minors throughout
    the tour and they should be always aware about their whereabouts.
    b.) Minors under age of 18, travelling with one of the parents must have a notarised letter of consent signed by the parent who is not travelling. If one parent is deceased or the child has only one legal parent, a notarised statement of the same must be obtained and carried as a proof on tour. Few countries may issue a minor visa which is linked to the visa of an adult who has applied together with the minor and must accompany the minor on tour. To obtain a visa for a minor which is not linked, NOC of both parents will be required by the consulate/ embassy for visa application.
    c.) Failure to submit the appropriate documentation may lead to cancellation of the tour, in which case the company is not responsible for any consequences or losses.
  • Immigration:
    a.) Holding a valid visa only allows a guest to enter the respective country’s immigration point. Granting or rejecting the permission to enter that country is solely upon the discretion of the immigration authority of that country.
    b.) Sometimes a guest may be interrogated/ held back/ deported by the immigration authority. In such cases, the guest may miss out on the itinerary program or will have to join the tour in-between or discontinue the tour. All the expenses incurred in this situation will be borne by the guest/s and Travel Frame is not responsible for the same and guest will not be eligible for any refunds and compensations from Travel Frame.

9. TOUR ITINERARY

  • Travel Frame tries its level best to operate the tour as per the original tour itinerary. The itinerary given at the time of booking or mentioned on the website/ brochure/ leaflet is based on the information available at that time and is subject to change depending on various factors such as state or country regulations/ airline/ cruise/ rail/ road transport/ hotel/ sightseeing etc.
  • Travel Frame reserves the right to change/ alter/ amend the itinerary before the tour departure or while on tour. The information about the same will be conveyed to the guests via email/ SMS/ call or by the Tour Guide while on tour.
  • Changes in the original tour itinerary can be caused by Force Majeure events, fairs, festivals, sports events, weather conditions, traffic problems, cancellation or re-routing or overbooking of flights/ cruises/ railways, overbooking or closure of hotel, closure of entry of a sightseeing attraction etc. This unforeseen situation may attract additional charges which have to be borne by the guest.
  • For the betterment of the itinerary, Travel Frame reserves the right to add/ delete/ exchange the sightseeing attractions or any other service. In this case if the additional new sightseeing or service requires extra charge then it will have to be paid by the guest.
  • In a few tour itineraries certain sightseeing attractions/destinations are planned on specific dates/days, for e.g., full moon day, Independence Day, republic day etc. Due to any unavoidable reason or political movement, if we are unable to visit these sightseeing attractions or destinations then we will try to visit the same on an alternate day. In case a visit is not possible at all, we will try to arrange an alternate sightseeing or refund the entry fee for the same.
  • In case if any sightseeing place is not visited or adventure activity is not done due to certain reason then an alternate sightseeing may be arranged, wherever possible. If an alternate cannot be arranged and a refund is applicable, then it shall be paid in INR only.
  • Any mishap on tour may result in change of itinerary.
  • In any booked tour/ package/ service which include helicopter, seaplane, cruise, ferry etc. would be subject to availability/ weather conditions/ local body permissions/ any other statutory requirements. Travel Frame is not responsible for any operational deficiency under any circumstances whatsoever. Under unavoidable circumstances, Travel Frame reserves the right to use alternate product/ service/ sightseeing etc. instead of the one advertised or published. In either case, the company shall not be liable for any damage, additional expense, or consequential loss suffered by the guest/s.
  • Guest may note that changes in the itinerary are due to various factors beyond our control, Travel Frame shall not be liable to pay any compensation/ damages on account of the same.

10. FLIGHT TICKETS

  • Terms of the airlines
    a. The airline tickets booked through Travel Frame are subject to the terms & conditions of the concerned airline, including but not limited to cancellation and refund policies.
    b. Travel Frame merely acts as a facilitator to enable the Guest to book a flight ticket. The contract of service for utilization of the flight is always between the Guest and the concerned airline.
    c. Airlines retain the right to reschedule flight times, route, change or cancel flights or itineraries independent of and without prior intimation to Travel Frame. As a facilitator Travel Frame has no control or authority over the logistics of the airlines and therefore is not liable for any loss, direct or incidental, that a Guest may incur due to such change or cancellation of a flight.
    d. Different tickets on the same airline may carry different restrictions or include different services and price.
    e. The baggage allowance on given fare is as per the terms decided by the airline, and Travel Frame has no role to play in the same. Some of the fares shown in the booking flow are “hand baggage fares” which do not entitle the Guest for free check in baggage and therefore the Guest will be required to pay separately for check in baggage. The prices for adding check-in baggage to a booking may vary from airline to airline. The Guest is advised to contact the airlines for detailed costs.
  • Code share
    a. Some airlines enter “code share” agreements with other Airlines. This means that on certain routes, the airline carrier selling or marketing the flight ticker does not fly its own aircraft to that destination. Instead, it contracts or partners with another airline to fly to that destination. The partner airline is listed as “operated by” in the booking flow.
    b. If your flight is a code share, it will be disclosed to you in the booking process and prior to payment.
    c. Travel Frame will disclose any such code-share arrangements to the Guest, only when the ticketing airline discloses it to Travel Frame in the first place.
  • Pricing
    a. The total price mentioned to the Guest are inclusive of base fare, applicable government taxes and convenience fee. Guests are required to pay the entire amount prior to the confirmation of their booking(s). In the event the Guest does not pay the entire amount, Travel Frame reserves its right to cancel the booking. Guest agrees to pay all statutory taxes, surcharges and fees, convenience charges as applicable on the date of travel.
    b. To avail infant fares, the age of the child must be under 24 months throughout the entire itinerary. This includes both onward and return journeys. If the infant is 24 months or above on the return journey, Guest will be required to make a separate booking using a child fare. Any infants or children must be accompanied by an adult as per the terms of the airlines.
  • Check-in terms
    a. Guest should check with the airlines directly regarding the check-in timings. Usually, check-in begins 2 hours before departure for domestic flights, and 3 hours before departure for international flights.
    b. Guest should carry valid identification proofs, passport, age proofs as may be required to prove the identity, nationality and age of the passengers travelling on a ticket, including infants.
  • Use of flight segments
    a. In the event Guest does not embark on the onward journey, the entire PNR pertaining to that booking shall be automatically cancelled by the airline. In such a scenario Travel Frame has no control in the said process nor will be obligated to provide alternate bookings to the Guest. The cancellation penalty in such an event shall be as per the applicable airline rules.
  • Changes to existing booking
    b. Any changes that are made to any existing booking shall be subject to certain charges levied by the respective airline, apart from the service fee charged by Travel Frame.
    c. The Guest shall be obligated to pay applicable charges in the event of any alteration or modification to an existing booking. However, depending on the airline’s policy and fare class, charges for changes or modifications to existing bookings may vary.
  • Refund
    a. Refunds will be processed as per the airline fare rules and cancellation policy. Such refunds shall be subject to Travel Frame receiving the same from the airlines. However, the convenience fee paid to Travel Frame paid at the time of booking is a non-refundable fee.
    b. All cancellations made directly with the airline need to be intimated to Travel Frame, in order to initiate the process of refund. The processing time for refunds may vary depending on the mode of payment, bank etc. The refund shall be processed after deducting the Travel Frame service fee which is independent of the convenience fee as mentioned above.
    c. The refund will be credited to the account of guest of which guest will provide the details.

11. HOTEL BOOKINGS

  • Travel Frame acts as a facilitator and provides platform to the guest to select a particular hotel. Hotels in this context includes all categories of accommodations such as hotels, home-stays, bed and breakfast stays, farm-houses, and any other alternate accommodations.
  • All the information pertaining to the hotel including the category of the hotel, images, room type, amenities, and facilities available at the hotel are as per the information provided by the hotel to Travel Frame. This information is for reference only. Any discrepancy that may exist between the pictures and actual settings of the hotel shall be raised by the Guest with the hotel directly, and shall be resolved between the Guest and hotel. Travel Frame will have no responsibility in that process of resolution, and shall not take any liability for such discrepancies.
  • Information from the hotel and the terms of the hotel
    a. The hotel booking voucher which Travel Frame issues to a Guest is solely based on the information provided or updated by the hotel regarding the inventory availability. In no circumstances can Travel Frame be held liable for failure on part of a hotel to accommodate the Guest with a confirmed booking, the standard of service or any insufficiency in the services, or any other service-related issues at the hotel. The liability of Travel Frame in case of denial of check-in by a hotel for any reason what-soever including over-booking, system or technical errors, or unavailability of rooms etc., will be limited to either providing a similar alternate accommodation at the discretion of Travel Frame (subject to availability at that time), or refunding the booking amount (to the extent paid) to the Guest. Any other service-related issues should be directly resolved by the Guest with the hotel.
    b. Hotels reserves the sole right of admission and Travel Frame has no say whatsoever in admission or denial for admission by the hotel. Unmarried or unrelated couples may not be allowed to check-in by some hotels as per their policies. Similarly, accommodation may be denied to guests posing as a couple if suitable proof of identification is not presented at the time check-in. Some hotels may also not allow local residents to check-in as guests. Travel Frame will not be responsible for any check-in denied by the hotel due to the aforesaid reasons or any other reason not under the control of Travel Frame. No refund would be applicable in case the hotel denies check-in under such circumstances.
  • Responsibilities of the guest
    a. The Guest would be liable to make payments to good for any sort of damage(s) caused by any act of him/ her/ or their accompanying guests (wilful/negligent) to the property of the hotel in any manner whatsoever. The extent and the amount of the damage so caused would be determined by the concerned hotel. Travel Frame would not, in any way, intervene in the same.
    b. The primary guest must be at least 18 years old to be able to check into the hotel.
    c. The Guest must be in possession of a valid identity proof and address proof, at the time of check-in. The hotel shall be within its rights to deny check-in to a Guest if a valid identity proof is not presented at the time of check-in.
    d. Check-in time, check-out time, and any changes in those timings, will be as per hotel policy & terms. Early check-in or late check-out request is subject to availability and the hotel may charge an additional fee for providing such services.
  • Additional charges by the hotel
    a. The booking amount paid by the Guest is only for stay at the hotel. Some bookings may include breakfast and/ or meals as confirmed at the time of booking. Any other services utilized by the Guest at the hotel, including laundry, room service, internet, telephone, extra food, drinks, beverages etc. shall be paid by the Guest directly to the hotel.
    b. Hotels may charge a mandatory meal surcharge on festive periods like Christmas, New Year’s Eve or other festivals as decided by the hotel. All additional charges (including mandatory meal surcharges) need to be cleared directly at the hotel. Travel Frame will have no control over waiving the same.
  • Payment for bookings and any additional payments
    a. Booking of a hotel will be “Prepaid” from Travel Frame.
    b. In “Prepaid” model, the total booking amount is paid by the Guest at the time of booking itself. Such total booking amount includes the hotel reservation rate, taxes, service fees as may be charged on behalf of the actual service provider, and any additional booking fee or convenience fee charged by Travel Frame.
    c. At the Travel Frame’s sole discretion on case-to-case basis, the Guest may also be provided with an option to make a part payment to Travel Frame at the time of confirmation of a booking. The balance booking amount shall be paid as per the terms of the bookings. Travel Frame may cancel the booking if guest is failed to make the full payment.
    d. Some banks and card issuing companies charge their account holders a transaction fee when the card issuer and the merchant location (as defined by the card brand, e.g., Visa, MasterCard, American Express) are in different countries. If a Guest has any questions about the fees or any exchange rate applied, they may contact their bank or the card issuing company through which payment was made.
    e. Some accommodation suppliers may require Guest and/or the other persons, on behalf of whom the booking is made, to present a credit card or cash deposit upon check-in to cover additional expenses that may be incurred during their stay. Such deposit is unrelated to any payment received by Travel Frame and solely at the behest of the Hotel.

12. CAB BOOKING

  • Definitions
    a. “Cab” as may be used in this document includes all categories of transport vehicles like sedans, hatchbacks, sport utility vehicles, multi utility vehicles, and any other vehicle meant for transporting passengers.
    b. “Cab Operator” means all the cab operators providing their vehicles along with their drivers.
  • Types of cab bookings facilitated by Travel Frame
    a. Outstation Cab: This enables Guest(s) to book vehicles operated by cab operators having All India Tourist Permit (AITP) vehicles and operating between two separate cities. On the basis of the demand/requirement of the Guest, Travel Frame as a facilitator connects the Guest with the concerned cab operator.
    b. Car Rental (intracity and intercity): This enables Guest to book vehicles operated by cab operators having AITP license on hire/rental basis. This service shall be provided for both intercity and intracity on exclusive basis by booking the entire Vehicle of the cab/taxi operators.
    c. Airport Drop: This shall exclusively cater to the needs of Guest intending to travel from and to the Airport. The service provided is intracity in nature and shall not facilitate the Guest to book intercity Airport drops.
  • Role of Travel Frame and limitation of liability
    a. Travel Frame does not operate cab services on its own. In order to provide a comprehensive choice of cab services, cab types and prices to Guest, it has tied up with many Cab Operators.
    b. Travel Frame acts only acts a facilitator between the Cab Operator and Guest. The transaction is always between the Cab Operator and the Guest.
    c. It is the sole responsibility of the Cab Operator to ensure it has all the requisite licenses, approvals, insurance and permits from appropriate authorities required to undertake the travel booked. Travel Frame gives no warranty or assurance regarding requisite licenses, approvals, insurance and permits which the Cab Operator is supposed to obtain from appropriate authorities.
    d. Travel Frame shall not be responsible in any manner whatsoever for any claims with respect to the trip including without limitation, claims pertaining to timeliness, safety, continuity, uninterrupted travel, quality, conditions of vehicle or driving skill, the Cab not departing or reaching on time, behaviour of the cab driver, interiors of the Cab, cancellation of the trip by the Cab Operator due to any reason whatsoever, the baggage of the Guest getting lost, stolen or damaged, the Cab Operator providing a
    different type of Cab to the Guest, the Guest waiting at the wrong boarding point, the Guest being dropped to nearest location by the driver of the Cab due to any unavoidable circumstances, or any act or omission of Cab Operator causing accident, loss of life to the Guest.
    e. Travel Frame will not be liable to Guest or to any other person for any direct, indirect, incidental, punitive, or consequential loss, damage, cost or expense of any kind whatsoever and howsoever caused from out of the information derived by Guest through usage of Website, in so far as such information is provided by the Cab Operator.
    f. In case of break down or accident of Cab where Cab Operator has been unable to make alternative Travel Frame will arrange alternative cab. Any claims, liabilities or legal costs arising out of such event shall be borne by the Cab Operator.
  • Responsibilities of the guests
    a. The Guest must carry a valid photo-id proof during the trip and present the same to the Cab Operator or driver of the Cab before boarding the Cab. In the event of a mismatch in the identity of the Guest or traveller, the Cab Operator or the driver of the Cab may, at their discretion, deny boarding to such Guest.
    b. Cab Operator is obligated to commence the trip as soon as the Guest boards the Cab. Guest shall report to Travel Frame in case the driver denies to commence the trip for any reason whatsoever.
    c. Guest shall board the Cab on or within such time as informed at the time of booking or provided in the booking voucher. In case the Guest fails to board the cab within the given timeline, Cab Operator will have the liberty to cancel the booking without informing the Guest.
    d. Guest will not have any right, title or interest in the Cab provided for the given trip.
    e. Once a Trip is booked by Guest, changes in departure time, boarding or dropping points are not permitted.
    f. Any failure by Guest to board the Vehicle within the given timelines at the boarding point or trip commencement point, shall result in forfeiture of the total booking amount paid by the Guest without any refund rights.
    g. Guest shall stop and take breaks at specified places only. Guest shall avoid taking additional breaks except in case of emergency.
    h. Guest shall be responsible and liable for their own safety and security of luggage. Travel Frame shall not be responsible for any loss to Guest or their luggage in any event.
    i. In the event of any dissatisfaction with any of the services provided by Cab Operator or Travel Frame, the matter must be reported directly to Cab Operator or Travel Frame, in order that appropriate action may be taken to remedy the problem.
    j. The booking made by the Guest should be strictly for tourism purposes only.
    k. The trip should be undertaken in the Guest’s personal capacity and shall not be used for profit making in any commercial context.


DO’s AND DON’Ts FOR THE GUEST

  • The guest shall:
    a. Arrive on time at the appointed pick-up point as mutually agreed with Cab Operator;
    b. Maintain and ensure good and humble conduct with Cab Operator during the trip and on failure to do so, Cab Operator may require such Guest to disembark the Cab;
    c. Prior to commencement of trip, check and agree with Cab Operator on dimension/weight of the luggage that can be accommodated in the boot space of the Cab;
    d. Check the starting time and the reading on the odometer at the start of the trip. Disputes regarding the same will not be acceptable after completion of journey.
  • The guest shall not:
    a. Ask Cab Operator to violate any traffic rules, or the city police or government rules or other applicable laws for any reason whatsoever;
    b. Coerce Cab Operator to overload the boot space of the Vehicle with the Guest’s luggage;
    c. Use services offered under this head for any purpose which is unlawful or illegal under the applicable laws;
    d. Insist on disembarking at any place expect the point of drop as provided by the Guest at the time of booking;
    e. Board the Cab if he/ she is intoxicated or under influence of any drug or similar abusive substances.

13. TRAIN

  • COVID-19 Health Advisory
    a. Catering Service is not available and catering charges are not included in the fare.
    b. Blanket and linen shall be provided in the train.
    c. All passengers are hereby informed that downloading of Aarogya Setu App on their mobile phone, that they are carrying along, is mandatory.
    d. You must have read the health advisory issued by my destination state. You accept and shall abide by the same.
  • ROLE OF Travel Frame
    a. Travel Frame only acts as a facilitator for booking of train tickets and provides intending travellers merely with a platform to search for desired train tickets to be booked through IRCTC. All bookings or train reservations made through Travel Frame are subject to the applicable Terms & Conditions as set out by Indian Railways.
    b. Travel Frame has no control over the booking flow, scheduling/re-scheduling, cancellations, confirmation from RAC to confirmed, delays, meal, and berth preferences or any other lack or deficiency of services. Liability, if any, for the above-said stands against the Indian Railways.
    c. Change in boarding point and name of passenger are not supported by the Website.
    d. Train functionality on the Website will not be functional between 2345 hours to 0030 hours or as specified by IRCTC due to system downtime or any other reason beyond the control of Travel Frame.
  • Responsibilities of the guests
    a. At the stage of booking of e-tickets, customers will be automatically diverted to www.irctc.co.in website/app to input their IRCTC login credentials. Passengers are required to remember their IRCTC guest name and password in order to book trains on Travel Frame’s Site.
    b. E-tickets are booked and issued through Indian Railways only. Guests can book a maximum of 6 seats/ berths in a booking. Seat/ berth allotment is done by Indian Railways based on their allocation logic. Travel Frame does not guarantee allotment of preferred seat/ berth.
    c. Only passengers with a confirmed e-ticket are permitted to board the train.
    d. Passengers are required to carry valid ID Proofs at the time of travel or boarding the train.
    e. Please visit https://www.irctc.co.in or http://www.indianrail.gov.in for all relevant information/ queries pertaining to your bookings.
  • Payments for bookings, and cancellations
    a. Travel Frame’s service charges are non-refundable
    b. Bookings can only be cancelled through the app or the website. Offline cancellations are not permitted
    c. The bookings made on Travel Frame’s Site are subject to cancellation policy and charges levied by the Indian Railways. It may vary depending on the cancellation time and booking quota (tatkal/ general/ ladies/ premium etc.).
    d. Railways automatically cancel the fully waitlisted e-tickets after chart preparation. The refund in such cases gets automatically credited to your bank account used for booking such tickets after deduction of Travel Frame’s charges
    e. Railways may offer special concessions/ discounts for senior citizens, female passengers and children. The amount or extent of concession is not decided by Travel Frame. All customers are advised to check latest railways policies for applicable discounts.

14. ACTIVITIES AND OTHER SERVICES

  • Definitions
    a. ‘Activity’ includes day tours & sightseeing, spa & wellness, adventure sports, cruise, theme/ amusement parks, buffets & dining or any other service/product booked on the Website.
    b. The provider of the Activity will be referred as ‘Activity Provider’, who shall be solely responsible for provision of the products/ services booked by the Guest.
  • Role of Travel Frame and limitation of liability
    a. Travel Frame’s role is limited to facilitating the procurement of an Activity service by the Guest from the Activity Provider. The transaction or the service fulfilment relation is always between the Guest and the Activity Provider
    b. Travel Frame shall not provide pick up and drop facility for any Activity unless otherwise explicitly mentioned in the confirmation of the reservation.
    c. Travel Frame shall not be liable or responsible for:
    1. Any damage or loss, injury, accident, death, breakdown, irregularity, delay/change in schedule, cancellation without cause, inaccurate information, deficiency of service/product, or cancellation due to conditions not under the control of Activity Provider;
    2. The health, safety, and well-being of the Guest in the course of availing the Activity or thereafter;
    3. Any incidental or ancillary services which is directly purchased by the Guest from the Activity Provider;
    4. Any incorrect information provided by the Activity Provider.
    d. The maximum liability of Travel Frame will be limited to refund of booking amount which was received by Travel Frame for reservation of the Activity.
  • Responsibilities of the guests
    e. The Guest agrees to comply with the terms and conditions of Activity Provider in addition to Travel Frame’s Guest Agreement and Terms of Service.
    f. The Guest will be required to present the booking / confirmation voucher issued by Travel Frame in order to avail the Activity
    g. The Guest shall further be in possession of valid documents viz. identity proof, address proof, passport in case of Activity booked outside India or any other document as specified by the Activity Provider in order to utilize the Activity booked.
    h. The Guest may be required to sign a waiver/consent form, safety procedure form, medical declaration or other document before availing the Activity where mandated by the Activity Provider.
    i. The Guest shall reach out to Activity Provider directly for any concerns subsequent to the confirmation of reservation.
    j. The Guest should ensure that he qualifies all the eligibility criteria for availing the Activity including but not limited to age limit, weight limit, medical conditions etc. Guest understands that in case he is found unfit or illegible for the Activity, Activity provider may or may not allow the Guest to avail the said Activity.
  • PAYMENTS FOR BOOKINGS, AND CANCELLATIONS
    a. Reservations will be subject to cancellation and refund policies of the Activity Provider which may vary from time to time.
    b. Travel Frame may charge applicable taxes or service charge, convenience fees etc. wherever applicable.

15. CANCELLATION AND REFUND POLICY

  • For any tour or package the services are booked or blocked several months in advance, cancellation of such services earmarked for a particular departure result in forfeiture of money depending upon the time of cancellation of services with the supplier. Therefore, any cancellation of the tour/ service booked, will attract cancellation charges as specified hereinafter. Your tour also includes third party product or service like airline, cruise, railway, transport, hotel, restaurant, caterer, sightseeing company etc., the Terms and Conditions and Cancellation Policy of such third party would be applicable in addition to Travel Frame’s Cancellation Policy and Terms and Conditions.
  • The said Cancellation Policy is applicable to all guests of ‘Travel Frame’ who has booked service from Travel Frame.
  • The request for cancellation of any service/ tour must be submitted in writing, clearly stating the reason for cancellation via email to Travel Frame at travelframe1@gmail.com, from guest’s registered email ID.
  • Once the booking is cancelled, it cannot be reinstated. Any reversal/ re-booking will be treated as fresh booking and additional charges may apply.
  • All guests expressly agree to the foregoing policy and terms.
  • Cancellation done by/ for/ due to:
    a. Guest cancels the tour due to any personal reason:
    1. After booking guest may have any personal reason like non sanction of leave, exam
    postponement, illness, family emergency etc. which leads to cancellation of their tour/ package.
    2. Date of the cancellation request email sent by the guest (unless decision withheld or changed), will be considered as the date of cancellation and the cancellation charge will be applicable accordingly.
    b. Considering the safety of the tourists, Travel Frame is compelled to postpone/ reschedule the tour under force majeure situation or due to uncontrollable factors at the destination, however guest/s do not wish to continue and cancel the tour:
  • Travel Frame reserves the right to cancel/ postpone/ re-schedule any tour under force majeure situation like natural calamity, epidemic, pandemic, terrorist activities, political unrest, curfews, local riots, government orders etc. or uncontrollable factors like airline operation/ schedule change, disruption due to political/ sports/ local/ VIP event etc. at the destination considering the safety of the tourists.
  • Under any such force majeure situation/ uncontrollable factors, no refund – fully or partially will be applicable. As refund is not applicable, guest will be required to choose the next possible future date of the same tour. If there is any price difference for the future tour, guests will have to pay the same before the tour departure.
  • To reschedule the tour in force majeure situation/ uncontrollable factors, Travel Frame will send the request to all the concerned associates like airlines, hoteliers, transporters etc. for their cooperation and assistance in postponement of the services. In case these associates are not able to consider the request, then actual cancellation charges may apply.
  • If guest wants to change the destination, then decision will depend on the cooperation of the associates like airlines, hoteliers, transporters etc. Such a decision will require time and will be given as early as possible. If the selected tour’s price is more, then guest will have to pay the difference before the tour departure. In case the tour price is less, then the remaining amount will be kept in a credit shell with Travel Frame. No refund is applicable for the credit shell.
  • Guest cancels the tour due to non-acceptance of change in itinerary/ service:
    a. For the betterment of the itinerary or under unforeseen situation, Travel Frame reserves the right to add/ delete/ exchange the sightseeing place/s or any other service and on this ground, guest will not be able to withdraw from the tour.
    b. In this case if the additional sightseeing or service requires extra charge then it will have to be paid by the guest.
    c. If any guest is not willing to accept the said change, then guest will have to cancel the tour and cancellation charges as per the Cancellation Policy will be applicable.
  • Deemed Cancellation – Guest’s booking stands cancelled due to visa rejection/ delay:
    a. Rejection/ delay of visa will lead to deemed cancellation and the booking will stand cancelled without any intimation or confirmation from the Guest.
    b. Visa rejection date will be considered as the date of cancellation and the cancellation charge will be applicable accordingly.
    c. Guest can re-apply by paying additional visa charges, however granting of visa is at the
    discretion of the respective Consulates and Travel Frame will not be responsible for the same.
    d. If visa is not granted even for the second time, the cancellation charge will be based on the date of the rejection of the second visa application.
    e. If no intimation of visa (granted/ rejected) is received from the respective consulate/ embassy before the tour departure, then it is considered as deemed cancellation and cancellation charge will be applicable.
    f. When visa is received from consulate, it’s copy is sent to the guest via email by Travel Frame, however sometimes consulates dispatch the passports directly to the guest’s residence. In both the cases it is the responsibility of the guest to check the visa sticker/visa copy and verify that the personal details and visa validity is accurate. Due to any incorrect details, if the immigration office does not allow the guest to leave or enter the country, then Travel Frame will not be responsible for any refund / losses / consequences.
    g. In certain cases, where air ticket/ visa is processed more than 91 days in advance, there along with regular tour cancellation charges, additional actual charges on account of air/visa fees will be applicable.
  • Deemed Cancellation – Guest’s booking stands cancelled due to the non-payment of partial/ full tour price:
    a. Guest is required to pay full tour price at the time of booking 30 days prior to the tour departure date. If the payment is not received during the mentioned time frame, then Travel Frame reserves the right to cancel the booking without any written notification from the guest and forfeit the paid amount.
    b. In such case, Travel Frame’s cancellation notice date will be treated as the deemed cancellation date and cancellation charges will apply as per the Cancellation Policy.
  • Deemed Cancellation – Guest’s booking stands cancelled due to ‘No show’ or absence on Day 1 of the tour:
    a. If any guest fails to join the tour on day one, it is termed as ‘No Show’ and will be treated as deemed cancellation and no refund will be applicable.
    b. All services will stand cancelled and 100% cancellation charges will be applicable, unless the guest notifies Travel Frame about joining the same tour later at their own expense.
  • Deemed Cancellation – Guest’s tour stands cancelled due to discontinuation from ongoing tour:
    a. If Guest discontinues/ terminates the tour for any personal reason, it is termed as deemed cancellation and no refund will be applicable.
    b. Travel Frame team will assist the guest to book the required services, however all expenses for the same will have to be paid by the guest immediately in advance.
  • In all the above situations, the cancellation charges will be applicable:
  • The cancellation charges include various direct and indirect expenses incurred for preparation and operation of the tour.
  • Travel Frame is not liable to give any details or bifurcation of the tour price or the cancellation charge.
  • Any refund payable to the guest as per the Cancellation Policy will be paid within 10 working days of receiving the final confirmation of cancellation request from the guest.

16. CANCELLATION OF THE TOUR BY TRAVEL FRAME

  • Travel Frame reserves the right to cancel any group tour/ package due to any operational reason or inadequate participation of the guests required to operate a group tour. In such case, cancellation of tour shall be communicated to the guest on their registered email/telephone/SMS/WhatsApp.
  • The amount paid by the guest will be refunded within 10 working days of cancellation of the tour.
  • The refund will be paid by A/C payee cheque/ NEFT/ RTGS.
  • Travel Frame will not be liable to pay any interest on the tour amount paid by the guest.
  • Travel Frame owes no responsibility for any additional expense related to any other arrangements made by the guest on their own.
  • A guest willing to take any other tour can do so in consultation with the respective Travel Advisor. Excess / short payment, if any for the new tour will be refunded/ collected, to/ from the guest.

17. RIGHT OF ADMISSION AND TERMINATION

  • Travel Frame reserves the right to deny any booking or cancel the accepted booking of any guest without divulging any reason or giving any justification.
  • Travel Frame reserves the right to terminate the tour of any guest while on tour if the guest does not follow the group tour decorum or misbehaves/ create nuisance to the co-passengers/ Tour Guide/ coach captain/ local citizens/ officials etc. Under such circumstance guest will have to make arrangements for their return travel on their own and no refund is applicable.
  • Transfer of Tour:
    a. If guests wish to transfer their original tour to a new tour for any reason, then such transfer is treated as cancellation of the original tour and hence a fresh booking of the new tour has to be made. Cancellation charges will apply on the net tour price of the original tour. For the new tour, prevailing tour price and discounts will be applicable.
    b. If guests wish to transfer the tour, they will have to communicate in writing to the Travel Advisor. Such requests will be accepted subject to availability.
  • Refund:
    a. Travel Frame reserves the right to determine the quantum of refund payable to the guest in case of cancellation, transfer, or amendment of the tour. Refund is calculated based on various factors such as the cancellation date, reduction in tour capacity, contractual agreement, and cancellation policies of associates like airlines, hoteliers, transporters etc. The decision given by Travel Frame on the quantum of refund according to the Cancellation Policy shall be final and will be paid directly to the guest.
    b. As per GOI regulations any refund from Travel Frame for both, Indian or International tours will be paid only in Indian rupees by A/C payee cheque/ NEFT/RTGS, even if guest has made the tour payment partly or fully in foreign currency.
    c. Refund is always processed in the name of the lead guest marked on the booking form or in case of ad-hoc/corporate group it may be in the name of the institution/company who has made the payment on behalf of the group.
    d. Travel Frame is not liable to pay any interest on the tour amount paid by the guest/s.
    e. Convenience Charge for the payments made by Credit Card, Debit Card, Online Transfer etc., is non-refundable.
    f. Tax Collected at Source (TCS) for international tours is non-refundable as it is deposited with the income tax department and recorded on guest’s registered PAN. TCS once paid cannot be reversed, however can be claimed by the guest while filing their annual Income Tax Returns.
    g. In case of force majeure/ uncontrollable situation Travel Frame reserves the right to levy nonrefundable ‘tour transfer charge’ or ‘service charge’ for standalone service.
    h. When tour price includes visa fee and if consulate/VFS/embassy procedure requires visa fee payment directly by the guest, then visa fee reduction will be given at the time of booking or will be refunded within 7 working days of submission of visa payment receipt by the guest.
    i. When tour price includes visa fee and guest holds a valid visa for the tour, they are required to submit the visa copy at the time of booking to avail the reduction of the visa fee. In case of unforeseen circumstances if tour reschedules then guest will have to get the visa done according to the new schedule and bear the costs of the same.

18. LIABILITIES & RESPONSIBILITIES OF TRAVEL FRAME

  • Travel Frame as an organization is a facilitator who coordinates with various independent service providers for tour related services which include but is not limited to airlines, cruises, railways, transporters, sightseeing companies, hoteliers, restaurateurs, caterers, snacks suppliers etc. Though the company takes utmost precaution to ensure the smooth operation of the tour, it has no control over the operations and the running of these service providers. Thus, in case of any issues faced by the guests at the time of availing the service (which is the sole responsibility of the service provider), Travel Frame shall not be responsible or liable for compensation of any kind of operational inefficiency, misrepresentations, acts, omissions, errors, warranties, breaches, or negligence on part of any service provider.
  • Travel Frame will not be liable for provision of medical care or the adequacy of any care that may be rendered in case of medical emergency or accident, and is not responsible for such risks and dangers that may arise beyond our control.
  • Any gesture of courtesy extended by Travel Frame towards guest/s in case of any force majeure/ unforeseen situation to minimize the impact, loss, or damage, will not constitute as an admission of such liability or a waiver.
  • In the age of a fast-moving world, human errors and omissions are expected. Travel Frame reserves the right to correct any mistake in tour price and re-invoice the guest even if the booking is made and confirmed, however if s/he disagrees and wishes to withdraw the booking and conveys the same immediately within 48 hours of the notification of such error, then the booking will be cancelled and advance paid by the guest will be refunded within 10 working days.
  • Sometimes a celebrity/ dignitary/ Travel Frame founder’s presence is advertised as a part of the tour itinerary, however due to unavoidable circumstances such assigned personnel may not be able to join the tour. Travel Frame will not be held responsible for the same.
  • For any withdrawal from the tour for whatsoever may be the reason, Cancellation Policy will be applicable. Company is not liable for any losses incurred by its guests in their personal capacity and hence have no liability relating to any loss of job/ business/ occupation/ contract/ interruption/ loss of business opportunity etc.
